Flo Omni is not liable for any loss or damage arising from your failure to comply with these responsibilities.
By using Flo Omni's services, you authorize us to collect, store, and process your data as described in our Privacy Policy. This includes information necessary to operate and optimize our services, including but not limited to communications, lead data, and customer engagement analytics. You further agree that Flo Omni may integrate with third-party tools on your behalf to fulfill contracted services, subject to the third parties' terms and data handling policies.
Flo Omni offers its services either on a subscription basis or through one-time service agreements. All fees, billing terms, and renewal periods are outlined during your service enrollment. By submitting your payment information, you authorize Flo Omni to charge applicable fees according to the selected service package. Unless otherwise specified, subscription services automatically renew unless canceled prior to the renewal date.
We make no guarantees regarding specific outcomes or results from using Flo Omni’s services. While we strive to enhance lead capture, response times, and operational efficiency, your success depends on various factors outside our control, including your industry, customer behavior, and your team's responsiveness. Our services are provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied.
To the fullest extent permitted by law, Flo Omni disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Flo Omni shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of, or inability to use, our services, even if we have been advised of the possibility of such damages. Our maximum liability to you for any claim shall not exceed the total amount paid to Flo Omni in the three months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless Flo Omni, its officers, directors, employees, and affiliates from any claims, damages, liabilities, costs, and expenses arising from your violation of these Terms, your misuse of the services, or your infringement of any intellectual property or other rights of any person or entity.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision under these Terms shall not be deemed a waiver of such right or provision.
These Terms are governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located within Montgomery County, Alabama.
